Gamestop's return policy for opened products is replacement only, while unopened products can be returned for a refund. Therefore an open game is of lesser value than a sealed one whether used or not.
They might have made an exception for this game but that doesn't change the fact that gamestop themselves value opened games in general less than sealed games, thus customers should do so as well.
