Well if it makes you happy, Nintendo made someone pay big time in Australia, but that was specifically piracy not homebrew. 

You mean that Australian guy who was distributing illegal copies of NSMBWii? Yea i remember that one, i wonder if he paid the 1.5 million dollar fine or was simply thrown in jail.

Regardless he suffered from "crimes", but that was a case of piracy not what this is. 

Also he most likely had to declare bankruptcy... or something, I doubt private law fines can result in jail time (could be wrong).
