The industry uses 1st and 3rd party all the time. Just go look at some financial statements and investor relations documents.
Nintendo can't claim 3rd party software as their software. They can claim 3rd party software they published as software they published. So, Nintendo can't claim Mario & Sonic at the Olympic games as a 1st party million seller. It is a 3rd party million seller. It has a Nintendo IP and it was published in Japan by Nintendo.
