Right now 3DS has the 3rd party support and the first party, on the DS-PSP the things was more third party efforts to PSP and Nintendo dominated on DS. It's the only way to go in the future, whetever you want it or not, it will happend. And given the time and capabilities of todays devices, I'd say we are on the edge right now. IPhone is successful with controled download only solution and people don't mind that (enough of them), so the only difference would be the size of the transfer. And it's the only way to make sure there is no piracy. And no used games market. There is more, just think about it, it doesn't have a single negative aspect for the publisher. And if it sucks for the customer (which doesn't) than too bad.
