So long as it looked sufficiently different I don't think there would be any confusion. Im not suggesting that it should look exactly like the original Wiimote, however its likely that even if it did look identical words like Wii Motion + would probably sort out any consumer confusion. It wouldn't be any worse than the confusion about which games do and do not use the attachment IMO at least.
