This is probably caused by lower-quality TN film- matrices used for the new LCD screen. At least the viewing angle on the top screen is much wors, therefore the usage of the lower-grade matrix is evident. I'm not sure about the yellow tinting of the lower screen, could be the screens protection fault (the plastic protector causing yellow tinting)
Anyway, it's a cheap move by nintendo. But, i doubt that would stop me for getting one for myself, because i cannot even get near gf's one... she plays it non-stop
