That makes no sense, though. Virtual Console has lots of 3D games, and Rare own the rights to Banjo-Kazooie - Not to DK. Anything and everything Donkey Kong is owned 100% by Nintendo.

It could be similar to Goldeneye, though with the roles reversed.  With Goldeneye, Rare has 100% rights to the game, but Nintendo owns part of the coding (or something) so Rare would have to completely recode the entire game in a different way in order to get around it.  Could be the same deal with DK, where Nintendo owns the franchise but Rare has some stake in the code.

Though I have no idea how the 2D DKC games got up there if that`s the case.
