According to rumors (most recently repeated by the IGN podcast two weeks ago), Nintendo tried that, but Tecmo balked. Not sure how much I believe that, but since Nintendo's not really in the habit of releasing broken games, and seeing how they're treating this particular one, it's more plausible than it should be. Which is bad, because if it's true, I don't see the game ever being fixed.
