Because PKMN titles are developed by a non-Nintendo-owned studio. The studio may be second-party, but they still aren't owned by Nintendo.

Pokemon IS owned by Nintendo.

 

1/3 of Pokemon is owned by Nintendo.  One third is owned by the Pokemon Company and the other third is owned by Creatures Inc.

 

I thought they had wholly bought out Creatures, or did they do that to Game Freak?

 

One of them they now own completely.
