Where are you getting that they had the sound off in those tests? And I play in darker areas a significant amount of the time where I really want the brightness as low as it can go.
It's probably more like 4-6 vs. 5-8 (taking out the extra brightness setting on DSi) with an added option of MOAR POWER to the lights.
