He's talking about the potential re-release of Mother 2 (Earthbound) on the Virtual Console. Nintendo made a comment a few months ago that it would never be done due to legal issues. The game parodies a lot of different things, and Nintendo is worried they'll get sued. The reason why they could originally release the game years ago is because times are different. I believe they basically blamed the internet and how fast and widespread information gets transferred to people on it.

 

Then again, aren't there parody protection laws? I really think that if Nintendo put a little effort into it, they'd easily get a clearance for "go" on VC.
