How bad of a condition must your DS be to send in for repairs?

I just got a DS from my friend for free. She just gave me the DS raw and New Super Mario Bros. (No box etc) The touch screen (and DS is general) is pretty scratched up and power button feels really stiff like its gonna come off.

I registered it at Nintendo.com and it said the warranty was extended 90 days. So I check the support and seems I can send it in for free of charge.

Question is will my problem be enough? Does it have to really be fucked up for them to repair the DS?
