LOL, it's a mock up. Either way, that answer sounds like an evasive answer from Ubisoft more so than a confirmation. Any Nintendo news is treated by strict and utmost confidentiality. Last time there's was an actual leak somebody got fired. Besides, that Nintendo Network icon on the image in question looks off.

Same here.  Their response lost all credibility with that.

Saw this from another few sources, so it could be true. The all blue case could get tiresome, but it's a nice shade of blue so I won't complain too much.

But I thought they were going to unify and expand what they were doing in Japan with the coloured cases depending on the ratings.

I like how it brings to mind the gamecube box, and the blue-white logo is simple and clean. The golden lining makes it suitable for happy and dark themes alike.
