Forums - Gaming Discussion - Microsoft tries to dismiss a lawsuit: Blames Wii and Apple

This's a good condidate for the WTF note of the week. You see, Datel a company that make memory cards, controls and other stuff wasn't happy to see Microsoft banning the use of third party cards, so they tried to set a lawsuit against Microsoft for Monopoly, and what's Microsoft answer??

Now Microsoft has answered back with a motion to dismiss the suit and they're pointing out the success of the Nintendo Wii and Apple Macs to do it. The dismissal points out that Datel's suit seems to forget that the Wii also has online gameplay and has sold far more than the 360, but Datel doesn't mention it at all in its suit. How can the 360 have a monopoly on Multiplayer Online Dedicated Gaming Systems when they aren't even the top selling system with that functionality (they also point out the DS has the same ability and has sold more as well), Microsoft is arguing.

As if touting Nintendo's amazing sales and online capabilities wasn't odd enough for Microsoft, it seems that the real savior for the company in this legal battle may be Apple. I'll explain after the jump.

But the fun doesn't stop there, check Datel's answer:

"Nintendo's Wii system has limited multiplayer functionality and is widely understood to be designed with families and casual gainers in mind," Datel said in its initial complaint. (PDF, 20 pages) "The Wii's reduced functionality and lower price point reflect a target market that is distinct from that of Microsoft's Xbox 360 and Sony's Playstation 3. Accordingly, the Wii is not regarded by consumers as reasonably interchangeable with the Xbox 360 and the Playstation 3, and the cross-elasticity of demand between these products and the Wii is low."

So there you have it. Not only the messages boards and forums are filled with this kind of things, now you can use the Wii (and Apple) for everything, so if Barack fails at the Health Care Plan don't be surprised if he blames the Wii too.

I'd love to see if they've actually measured this, but it's something I've been saying for ages, and it shows why the PS3 and XBox 360 are not direct competitors for the Wii (because they are not substitutes).

omg...over dramtics and lack of comprehension, there not blaming NINTENDO there saying " hey!..why are these guys only pointing us out on having a Market monopoly, when when were not even the matket leaders!" There not saying anything negative* note this only in reference to 1st part*



Nintendo and their Wii are the scapegoat of this gen!
