Between Somalis and XBL whiners the image of pirates has really been dragged through the mud recently.


If the ban had been enacted before the release of MW2 and Halo 3: ODST, the law firm supposes that sales of both games would likely have been “greatly diminished.”

im a huge playstation fan, but i have SO much respect for Microsoft banning them people, they know they shouldnt have been moding there system and pirating games, SO what if MS did it to make an advantage to them? good on them! hope this doesn't go through!

I wonder if they can even sue.

A lot of "terms of use" require disputes to be settled via arbitration (look at your credit card agreements or insurance policies).

Plus, if the bans are within the scope of the terms of use, I don't see how there could be a case.

Heres a better idea, why dont this lawfirm start a class action against the pirates on behalf of all the game publishers/developers to reclaim all the money lost when the pirates downloaded the games illegally. Would make a lot more sense and would be more likely t succeed.



If someone were to go to a casino and play Craps with modded dice, I wouldn't expect the casino to let them keep any of chips (including those they bought in for) if they were caught. They know going into it that they're cheating the system, much like these modders who sign up for a legitimate online service. Good for Microsoft and bad for this law firm for tying up the legal system even more than it already is

Actually I think only modding firmware itself is illegal, I think legally you're allowed to do whatever you want to the hardware, but not software, but the firmware is embedded right? I don't really know the whole story -.- haha.



I hope Microsoft brutally bends these people over a table. There is no way this should ever make it through, why it was even thought of is ridiculous.

If this goes through, then I am going to open up a class action lawsuit against the Illinois State Police for giving me a speeding ticket in my Corvette, since that is what the car was built for after all.
