Are they legally allowed to do that? Even if it's not the same name, it's definitely his likeness

Probably not in Japan. The Fire Pro Wrestling series has gotten away with using carbon copies of famous wrestlers for years, simply by changing the name (e.g. Undertaker = "Undead Taylor" ).



errr yeah but carbon copies of humans in games are not really carbon copies....

There it's an obvious stunt to steal the selling power of these designs without paying royalties.... and they are game characters from rival companies.
If I were nintendo or square I'd be pissed, not that you can create them in the game, but that From software distributes them. If you look at the pictures I'm sure I've seen a few with "copyright from software"... which is where it's basically lying.

This is theft of intelectual property in order to make a profit. Feel as you want about it, but it's the worst kind of IP piracy there is, akin to copy and resell selling fake copies.

I think the game looks great and copying zelda is a great idea (cause it rocks), but there I think they have crossed the line and I hope they get sued for it... Otherwise i'll go fund a game with boxman, bluehedgehog, Marco&Leni and gordon fryman ...

Square won't do shit. They are a major shareholder in Silicon Studios, the company that developed the game. Namco Bandai is too, so they won't care either that they have one that looks like Patty Fluer. They could make Sony characters too since Sony is a major shareholder as well. All are members of the board.

As for Nintendo, what can they do? Zelda NES gameplay style isn't patented.

As for the Link lookalike, it's free Zelda publicity.

It's pretty much the same, though, at least from a legal perspective. The Fire Pro series had blatant ripoffs of all the various Japanese wrestling promotions, most of which had their own licensed video games. Japanese copyright laws are simply much more lax when it comes to anything that can be construed as a parody; a simple change of names will usually do the trick.
