yeah some people get it way sooner.
i remember MGS4 / Infamous released here a whole month before US or UK got it. they normally break the street dates in not very known stores in a plan to raise the debut sales numbers and be all "Look it did AWESOME in first week!"

They will be banned so why worry. I'm pretty sure Microsoft will check out everyone who has this game on their tag and played it before the release date. If you play games before release frequently then sooner rather than later you will get banned, ODST and MW2 will be the ban hammer titles this year.
