Sony let Rockstar out of GTA exclusivity when it became apparent that the PS3 was not selling as well as hoped in 2007 and wouldn't make the revenue required in game sales. MS jumped at the news and ponied up cash to first try to buy exclusivity of GTA 4. Apparently the rumor is Rockstar were close to signing but didn't want to sever ties with Sony who were responsible for them getting to their position of strength. As a result, MS offered an agreement for episodic DLC. In response to this, Sony signed an agreement with Rockstar to have first dibs at a new IPs - possibly two. The first is Agent, the second was rumored to be LA Noire, but this is still conjecture despite what unrelated Games Association people say in the press.
Agent will be locked as Sony IP. Possibly timed, but definitely exclusive to start. Brave decision, but business loyalty to past friends is very rare in this day.
