ROFL @ this clown. If hewanted to protect his code/work, going open source was the dumbest idea ever. That's like protecting your secret by telling everyone what is.
To everyone suggesting that he sue, good look @ that. He released it as open source. Do you guys not understand the concept of open source. The whole point is that there is no copyright. You're basically giving away all the code for free and you have no ownership rights. People can use it and modify it as they see fit. That's the entire purpose of making something open source. That's why you would do it. He should have released under the Creative Commons thing if he just wanted to show it off. Under that there are rules that you can't use modified version for commercial products and rules that say you can't change the creation.

The thing is the guy who made Aquatica didn't use it to educate himself like the purpose of released code but blantantly copy it and release the fl0w under a different title.


As of right now the offending application appears to have been taken down (don't know whether apple or the theif took it down). It is no longer listed with the theifs other works on itunes.

You really don't understand do you? When you release something as open source you lose all rights to it. That is it. You can ask people not to do certain things, but nobody has to listen to it. The vary nature of open source is that you're giving the code away for free for anyone to use and modify in any way that they see fit. That's the legal definition. You can ask them to pretty please not do it with sugar on top but nobody has to abide by those rules.
Like I said, releasing something on open source and not wanting it copied makes as much sense as protecting a secret by telling everyone in the world about it. Or better yet, it's like hoping people don't steal your life savings... and your securty scheme is to leave a stack of money in the middle of the street with a sign saying, "please don't steal me" on it.

I think one aspect of open source is that you can't use the code for a commercial product, which this game seemed to be.

How so? The "stealing" aspect is an idiot claim to me. It was released via open source. They can make as many blatant knock offs as they want. That's totally allowed in the rules of open source. People arguing that they should get in trouble because of that don't understand what open source is.
The only thing they did wrong was try to sell it. That violates open source.
Nobody in this thread was really arguing that they should get in trouble because they sold a game. It was all about them copying a game. Copying is totally legal with open source, selling it is not.
