Found this piece of news tonight....

'A man who tried to carry out a citizen's arrest on youths who he said were attempting to break into allotment sheds was himself arrested by police.

Phil Hennessey, 44, was arrested in Medway on suspicion of assault and carrying a weapon, and bailed until July. He spent a night in custody.'

I need to point out firstly there is no such law of citizen arrest in the UK, but you can detain a person for such a time until the police arrive as long as its lawful...  Were Mr Hennessey went wrong was that he chased the teenagers from his allotment, grabing one of them and holding him.  At this point the youngsters were well away from the allotment and paused no threat to him.

I belive Mr Hennessey did the right thing but the UK law is all wrong in this country.  Most criminals don't really care for the law and will rob and beat the crap out of you and have no shame in being arrested time after time and will hold thier heads up high but I find that law-abiding people who find them self arrested for what ever reason, being arrested can destroy them as a person and from within.

Saying that, if it happen in my house and I caught someone in my house who was trying to rob me.  I would beat that person to near death if I could, but by doing that I would end up in jail for some time.

 How does one detain someone without grabbing and holding? Does one simply use the legendary English Manners to politely ask if the chap would mind staying until the bobbies arive?
