From what I know, MS would have to pay some kind of royalty to Sony (don't know if it's different in Japan) for using a trademarked name. Advil and Tylenol do it all the time.
In this instance, I don't think Sony is going to mind too much. It's probably not going to help MS's image too much releasing this kind of thing. Plus, having the cute anime girl on the front will probably just give the impression that a foreign company is stereotyping their culture to be a bunch of Otakus.
