In a rare instance indeed, Soriku is in fact correct. Disney not only owns all the Kingdom Hearts characters, and the name of the series, but they can even create KH games without Square Enix. Evidence you say? I actually have all the proof right here:

Read through this carefully. The primary trademark is the one at the top. Disney Enterprises, Inc. They then mention it's developed by Square Enix, and go through the breakdown. Notice again, the primary trademark is Disney, then Touchstone owns The Nightmare Before Christmas. Then they go through Square's rights: The Final Fantasy Characters, and the Square Enix logo and name. That's it.

Again, proof enough that Square has no power over this game is Disney making one without any involvement from them at all. However, since you all needed the evidence there it is. Oh, and for the record: The fact that it's primarily owned by Disney really means nothing at all as far as what platform it will go to. Buena Vista Games is not exclusive to any platform. However, it does mean that future KH games can also be made without Square's envolvement. This could mean our favorite KH characters paired with other groups of characters. Come on Mushroom Kingdom Hearts!

Square enix published and developed the game, disney published the game. Square cando wahatever they please with the game as well. They both own the game by an equal amount.

SE developed and published it, but that doesn't really mean much as to ownership. The available information points to KH having apparently been developed with a lot of input from Disney....more than I thought...and apparently Disney has rights to the new characters in KH, just not the old ones. So that means as long as there are not Final Fantasy characters in it, Disney can do what they want. Would be messed up if all this was wrong and they decided to keep all of them on Sony consoles though.

That's correct. Although Square Enix co-developed and published it, it was developed with Disney's characters and under Disney's IP. The publisher does not automatically retain rights to a game. The best example of this is Banjo Kazooie, which was developed by Rare and published by Nintendo. However, Rare retained the rights to it, and when they were bought by Microsoft, Microsoft gained the rights to it with Rare.

Although I have to mention that KH would suck without the FF characters...I rather like KH 1 and 2, I hope they work with SE for it, those were pretty good games, and hopefully Disney will decide to continue working with SE to ensure the goodness. I had always thought Sora, Riku, and Kairi were owned by SE...eh, live and learn.

I agree. It would also suck if Square Enix didn't lend it's talented developers to the game. I'm not trying to argue that Disney should make KH games without SE, or even that the fact that it's mostly owned by Disney means it's going to any specific platform. It doesn't mean that at all. I'm just trying to clarify the facts.

Thats true. Square can do anything they want with the game as well.
...EXCEPT distribute, publish, use likenesses of, or otherwise misappropriate any Disney-owned IP (which includes all the disney characters, and apparently sora et al from Naznatips's post. They try doing that, and they are in a WORLD of pain. Disney's IP lawyers play to win, and they often do. Ever wonder why nothing new has entered the public domain in the US since 1937ish? The reason starts with 'M' and ends with 'icky mouse').
So no, SE really has almost no rights to the series beyond what Disney gives them contractually. Pretty much everything including the name KH is owned by disney... SE tries to do anything with said property that Disney doesn't like... well, lets just say that FF13's development might be cut a bit short.

Yeah, I wasn't saying that either...but on the other hand, SE isn't owned by Sony either, so they could put a KH game on whatever system they wanted, just the same as Disney.
lol about Disney that reminds me....around here, the Wal-Mart used to decorate cakes for you...you'd bring in a picture, didn't matter what it was of, and they'd put it on a cake. They can't do that anymore, because people occasionally brought in Disney character pictures to put on cakes, and Disney sued them over it.
