It seems that Tecmo is under the impression that NoA decided not to publish the title.

When asked about the game, Tecmo replied, "Nintendo holds the publishing rights to 'Fatal Frame Wii,' which was developed by Tecmo LTD. and Grasshopper Manufacture and released in Japan on July 31, 2008. Nintendo of America has since then decided not to publish the title in North America – consequently, the title will not be released in this territory. As the owner of the IP, Tecmo feels very unfortunate that the fans of the series in North America will not have a chance to play the game, but respects the final decision made by Nintendo of America."

I think both are pretty clear and consistent. Nintendo will not be publishing this title in the Americas... Maybe Tecmo is trying to get another distributor here?

I had just read about this. I've been waiting for this game. Maybe I'll just pick up the Japanese version some time, but I imagine it'll be a somewhat difficult one to read.

Edit: Oh yeah, and they could both be right. Nintendo of Japan could have told  NoA that they don't need to publish Fatal Frame 4 or just not said anything specifically about it in which case, NoA might not have the authority to do anything about it, so Nintendo could hold the publishing rights and just not currently be moving forward on it.
