Intra-marital rape was legal in England until 1991 and legal in the U.S. until 1993, but is still considered a lesser crime than 'real rape' by 33 states. In the U.S. before 1993, a man could rape his wife and it would be totally legal, even if they were already legally separated.
Hell, in India you CAN murder your wife and get away with it. You can even get your parents to help you burn her alive in your own house in front of the whole family. It happens about twice a day in India.

In the U.S. spousal rape wasn't even considered rape until the 1970s when the feminist movement really picked up some steam and fought to change the legal definitions. Then each state changed their laws one at a time. Very very slowly.
Even California didn't pass a spousal rape law until 1979. And then spousal rape could be a misdemeanor or a felony, but non-spousal rape was always a felony. And spousal rapes had to be reported within 90 days, but non-spousal rapes could be reported within 3 years This lasted until 1993. Now spousal rapes can be reported within 1 year, but still not 3. Now they're both always felonies, but it's still considered a lesser crime so spousal rapists get a chance at probation or a suspended sentence, and non-spousal rapists can't get either of those.
In Ohio, the offense of "sexual battery" does not apply to a spouse, and the offense of "rape" by the use of a drug or intoxicant which impairs the victim's ability to resist only applies to a spouse who is living separate and apart from the victim. So you can legally rape your wife in Ohio if you get her drunk enough or slip her some GHB.
In West Virginia, spousal rape gets a sentence of 2-10 years and non-spousal rape gets a sentence of 10-35 years.
