Actually sqrl, there is no modification needed and what was stated is fine.

Gay and Lesbian sexuality is pretty much the same thing. Only major difference is gender involved. Pretty much calling lesbianism wrong also spits in the face of the male population that is happy being gay. If you look at the definition of homosexuality it covered couples of a same sex and doesnt single out male or females as both lesbian and gay tendancies are both filed under homosexuality.

So in a nut shell, gay = lesbian = homosexuality.

 

Anyways, what Microsoft is doing period is highly discriminatory. Most services provide a spot for preference allowing for straight, gay, lesbian, bi, bi-curious. An XBL profile is nothing different then a myspace, facebook, PSN, facethejury, etc profile making it so that if a person decides to post their preference, even if there is no field provided and they just do it in an "about me" section, it is perfectly a-ok to do so. If one is banned for publicly stating their preference there are some massive legal issues when you look at discrimination laws in the USA and many countries around the world. Microsoft is putting themselves in hole that they wont get out of if someone actually pushes this subject.

Xbox Live is a gaming network whose main function is playing games with other people. Those other services' main function is for social networking. Plus, those other services have age restrictions and generally do not allow kids to see adult profiles or adults to see kid profiles. Xbox Live has no distinction between the two. Also, any word that refers to something of a sexual nature is aganst the TOS period. If you don't like it, too bad. MS can ban whoever they want from their service.  The simple fact is that most people think of a word like lesbian in a sexual sense. Just do a google search for lesbian and you will see that you won't find any lesbian non-sexual sites in the top million hits.

 

Live isnt like the PSN? PSN = PlayStation Network which is a gaming network. Other gaming networks include Steam, Impulse, and Xfire. All have nothing against stating sexual preference in the TOS.

You may not take any action, or upload, post, stream, or otherwise transmit any content, language, images or sounds in any forum, communication, public profile, or other publicly viewable areas or in the creation of any Online ID that SCEA, in its sole discretion, finds offensive, hateful, or vulgar.  This includes but is not limited to, any content or communication that SCEA in its sole discretion deems racially, ethnically, religiously, or sexually offensive, libelous, defaming, threatening, bullying or stalking.

A story surfaced yesterday about how a Lesbian Xbox 360 Gamer got banned from Xbox Live for listing herself as being Lesbian in her profile.

As always with controversial issues, fans jumped in and issues got heated as people debated if Microsoft and the Xbox Live service were discriminating against homosexuals.

Thank god for the industrious people of NeoGAF, who decided to put the whole issue to the test. One member added a simple statement to the end of his Xbox Live Bio - simply stating "Heterosexual." The people of the forum then reported him.

Several hours later he recieved notification of a 24 hour ban from Xbox Live and the removal of the 'inappropriate content' from his profile.

So there you have it - Xbox Live bans gays and straights. That rules out discrimination - but is it still wrong? We'll leave that one up to you.

Actually this just shows that there discrimination in the TOS against freedom of expression. So like the last question in that article states. Is it still wrong? the answer is YES.

You get more and more wrong with every post you make. It has NOTHING to do with discrimination. There would only be discrimination if they were banned because of their orientation. This is NOT the case. They were banned for using words that are against the TOS, which has nothing to do with discrimination. If you can't see this then you need to not bother posting anymore about anything EVER.

 

I just wont keep arguing because you dont understand Freedom of Expression in the USA and that the TOS goes against first amendment rights.

You don't have any right to freedom of speech on someone else's property, d00d. You can legally spout racial slurs all day long, but you will probably get tossed out of a restaurant if you do it there. And it doesn't violate your first amendment rights or anything else.

No it's not and you can skip the doom and gloom. It's happened several times already and Microsoft; if there was a case it'd be on the courts already. Because their ToS doesn't allow any kind of sexual reference, there's no discrimination involved from Microsoft. The discrimination comes from users, who are selective about what to report or not.

By the way, I'd like you to point me where it is written that you are allowed to state your sexual orientation (wether heterosexual or homosexual) within the context of online services.

Oh, Sony has a similar clause on their TOS. I wonder what would happen if a muslim living in Saudi Arabia reported a PSN profile making explicit the homosexual orientation of the user. It'd place Sony in a very difficult position. Either they deem it offensive or PSN could be declared illegal in a good chunk of the world as well as bleeding customers... the world is chock full of religious nuts.

Wow, this is your worst argument yet. No TOS violates any constitutional rights. Want to know why? Because those TOS agreements are for private services where the company has complete control over the content The company can choose to not allow anything they want to on their service. Don't like it? Don't use their service. It is just like how a store can refuse to sell to anyone they damn well please.
