Man Passes Gas, Charged with Battery on Officer

SOUTH CHARLESTON, W.Va. (WSAZ) -- As if getting a DUI wasn’t enough, a man arrested for driving under the influence got in a lot more trouble at the police station.

Police stopped Jose Cruz on Route 60 in South Charleston Monday night for driving with his headlights off.

Then, he failed sobriety tests and was arrested.

When police were trying to get fingerprints, police say Cruz moved closer to the officer and passed gas on him. The investigating officer remarked in the criminal complaint that the odor was very strong.

Cruz is now charged with battery on a police officer, as well as DUI and obstruction.

*facepalm* that cop is a dick , just slap him in teh back of the head not add what could be a year or two.....jesus christ people every body farts its a fact of life.....what a dick cop

If I got charged for every time I've farted on a Police Officer...

So when I fart on my kids that's battery? Fuck off. That's like saying you sneezing from across the room is battery because you're assaulting me with germs. Idiots.

That cop is a freaking jackass. Disrespectful? Yes. Assault? No.

Does this mean they can press assault charges against homeless people for smelling bad all the time?

Failure to shower could be considered criminal negligence rusulting in injury to the nostrils. I smell grounds for a lawsuit (no pun intended). I'm gonna sue the crap out of the next homeless guy I smell, I could really use an old shopping cart...

I honestly don't care. If a punk walked up to me and farted at me (it's a controllable bodily function) I'd want some payback...

You can't just say "it's just passing gas, everybody does it!" when he purposely went up and farted at the guy.  I don't know if "battery" is the right thing, but whatever.
