It was because that employee violated a non-disclosure agreement. Since Microsoft wasn't breaking the law, just being cheap and sloppy, the agreement is valid.

A flashy-first game is awesome when it comes out. A great-first game is awesome forever.

NDA's are serious business, even more so than the internet. It's a shame that these days you are forcefed NDA's if you want to land a job.

Well the risks of corporate espionage, or worse pirates getting their hands on the product even before launch, means there have to be some precautions. Then again, it is a shame that those are needed.

BTW, they of course are not serious as card games.

I want to disagree, but your understanding of the law is correct. There might maybe possibly be some whistleblower statute in the appropriate jurisdiction which would permit the contractor to recover damages, but the chances of that are near-nil.

Moral of the story: if you know your company is doing something that's wrong, but not illegal, speaking out will cost you...

Yeah he's an idiot for putting that on record...if he knew he was going to get in trouble for that he's an idiot.

Plenty of people know about defects with 360s...to lose your probably well-paying job over such a thing isn't worth it.
