so can you sue a company that spent loads of cash on internal development of this technology and the finished product is coincendently similar to an american company's product? like even if nintendo proved like dudes we built these from ground up, would the lawsuit still proceed?

How in the world can you patent swing like at bat. That's like trying to patent apples. What's next? The people who made laser pointers suing Nintendo. If Hillcrest laboratories wants to cash in they should just do what everybody else has done and put out shovel ware. At least it would be more dignified.

From my understand based on the other threads like this, is that it takes some time to get everything in order before you can file a patent infringement lawsuit against a company.
