According to Team Twiizer, the firmware to stop this was pushed out back in March, but Nintendo still have not updated the system menu (or any games) to utilise the latest firmware.
This brings the question, what is Nintendo waiting for? Given that there have been numerous chances to push out updated firmware (MKWii, WiiFit, WiiWare), why would they have given them 2 months to get this up and running, rather than stopping them beforehand, especially since WiiWare games can be pirated only because they haven't updated the system menu.
