Driver of car that struck and killed dog sues dog owners

DULUTH, Minn. - The driver of a car that struck and killed a dog in Minnesota is suing the dog's owners for damage done to his vehicle.

Jeffery Ely was driving near Duluth, Minnesota, on January 4th when Fester, a miniature pinscher, ran into the road.

Ely's 1997 Honda Civic struck Fester, killing the 5.8-kilogram dog instantly.

Now Ely is suing Fester's owners for about $1,100 for damage to his car, time he had to take off from his two jobs to get the car repaired, and court fees.

Ely tells Duluth News Tribune he feels sorry for the family's loss but feels they must be responsible for their pets' actions. He's a dog owner himself.

Fester's owners have countersued Ely, for $2,400.

In most places if you hit someones livestock, i.e. a cow, you must pay for the animal to the owner. So, I bet he will lose and have to pay for the dog.

I've often wondered why people aren't made to pay for the damage to other peoples cars when they get run over. I mean, if I'm out driving and someone runs out in front of me and smashes the shit out of my car, why should I have to claim on my insurance to repair it?

Well, there are other factors to be considered:

If the dog ran out into the middle of the street at the last second, then sorry, dog owners' fault.

If the driver was driving faster than the accorded speed limit, then it can be argued that it's the driver's fault.

If I were the driver, I wouldn't sue because, accidently or not, I killed the family pet.
