Well, there are other factors to be considered:

If the dog ran out into the middle of the street at the last second, then sorry, dog owners' fault.

If the driver was driving faster than the accorded speed limit, then it can be argued that it's the driver's fault.

If I were the driver, I wouldn't sue because, accidently or not, I killed the family pet.
