CMA had bad data on the Console Gaming Market which caused them to remove the SLC so that Microsoft couldn't appeal to CAT.

But by everything I'm looking at here, from analysts, lawyers and those who actually monitor the markets (I.E. NPD), they clearly have bad data on the Cloud Gaming Market too.

I think a CAT appeal has a decent shot of succeeding but it doesn't mean CMA will change their decision.

Apparently 67% of appeals still end up with the CMA making the same decision. So that puts Microsoft's odds at 33% + Flimsy data.

"We will work aggressively with Microsoft to reverse this on appeal," it said, calling the regulator's conclusions "a disservice to UK citizens, who face increasingly dire economic prospects."

- Activision also said it would "reassess our growth plans for the UK," and the UK was "clearly closed for business."

Talk about icing on the cake for what was a shit night for me lol. I’ll just say I’m never having pei wei again.

Of all the reasons I thought the CMA would block the deal, this wasn’t it lol. Whenever you’re able to make a decision and the only means to appeal is to essentially tell the exact same group to do it again, shows that body has WAY too much power and too little oversight. And for a region of gaming that is very much in its infancy.

That means the CMA won’t allow any deal from happening for at least the next decade if it involves cloud gaming lol.



Just pull out of the UK.

It's definitely not over yet, Microsoft has already said they're appealing to CAT, and if we were guided by logic and facts, I would also put money on it with you, but the fact is that CAT often sides with CMA and has to find that CMA has acted "irrational" to side against them and even if they do side against CMA, they simply tell CMA to make another decision, the same CMA acting irrationally, which can be another block. I don't actually know how many appeals a company is allowed either, I don't imagine Microsoft can just keep appealing to CAT over and over until they get the decision that they want.

What I have read though, is that CMA appeals are a lot shorter than EC ones (EC appeals can sometimes take years), and due to the size of the deal, Microsoft can expedite the appeal process, I'd be surprised if this deal is over this year now though, Microsoft will have to re-negotiate with Activision-Blizzard on the closure date and now they might as well wait for the FTC process to play out.

CMA already changed their mind about console market already and they expect an appeal of course. I think they'll work out something with cloud concerns too and CMA ends up looking strong even if they eventually approve.

Not everything in UK is failing thought. Beans on toast didn't! Just tried it last week at a hotel breakfast, it looked awful but taste was quite good. Would've been better if those beans weren't flavored with dill. Fuck dill, it's the CMA of herbs.
