Considering what was said here on what he done I side with Nintendo on this one. And well Nintendo can`t send anyone to jail, that is the police and judges.

I find it amusing that people credit Nintendo for the actions of the legal system.

Well Nintendo did ask for damage payment of $10mil.

That is a civil request, Nintendo can even report a crime to the police or judicial system, but Nintendo doesn't have power to jail anyone.
