A. They never promised that, they said "case by case basis"

B. They said they would uphold all current contracts, continue to support all games currently on PlayStation and they have.

C. They made a promise to keep Minecraft on PlayStation consoles and they have, they even release Minecraft spinoffs on PlayStation still (Dungeons/Legends) and they've even released Xbox IP onto other platforms (Banjo, Ori) but CMA doesn't seem it worth mentioning them, but they mention Project Midnight by Compulsion Games, Lol.

Phase 1 is an absolute clown show, they're outright lying in their report, Lol. This should be a slam dunk for Microsoft's lawyers.



As I was reading that tweet, I was immediately trying to think of when Microsoft promised that Bethesda games would remain multiplat even everyone here knew that wouldn’t be the case because Microsoft was being intentionally coy on the subject. The only question was whether games like Elder Scrolls VI was too big to be exclusive or Starfield was too late in development to be exclusive. Which the answer to both questions was no lol.

But Microsoft never said anything remotely close to that “statement”

They’ve even been releasing those “legacy titles” like the Quake Remaster, which is also what was promised.

D. Bethesda have only been part of Xbox for a little more than a year,  the only game released since then that isn't on PS console is Fallout 76: The Pitt. 

E. All there game have still been released on Steam so how is this not "Bethesda content available on multiple stores and platforms"



When I look over the concerns of the CMA, I actually believe that MS is still in a very strong position to get this done. The reason is if COD is the only big issue on the plate, then MS can easily do 5+ years condition that COD will remain on PS consoles. Lets be honest, I doubt that MS was going to pull it right away and if all they have to do is push up a few more years to land the deal then they are golden. There are a number of ways MS can promote COD on MS ecosystem and the advantages of having it in GP that buy the time this Console iteration has aged MS can then reevaluate making COD exclusive or not.

Actually Fallout 76: The Pitt is on PS lol. Xbox hasn't even received any exclusives from Bethesda to this day. I've even joked that Deathloop is the first new Bethesda game Xbox has added to their library and that was on PS5 for a year

I wonder if MS also might suggest that any PS owner can still play all their games by getting GP. You only need a Brower to play all the games that are cloud enabled. So you do not even need an Xbox console as you can play from your phone or PC. Also MS is giving the ability to play games that are not even on GP cloud capability which is another aspect that shows MS is way more open then Sony. There are a number of cases that can be made but I am sure MS rather rap this up then go to court as anything can happen in court.

Microsoft already signed an agreement with Sony to keep Call of Duty on PlayStation for "several more years" beyond the current deal Sony has with Activision Blizzard. I see Call of Duty remaining on PS5 for the rest of the generation, but after that we don't know for sure.
