But Sony. That's what you're doing right now. What.

Wow, that is like Dr. Evil levels of stupid right there

Backed up by facts though, I do agree, CMA looked more concerned about protecting Sony than protecting consumers, the CoD arguments are junk, and the focus should be on Azure's dominance, Brazil basically put down every "exclusivity" argument.

Xbox as a platform is seventh place in PC? Yikes. Does that mean Steam, EGS, GOG, Origin, Battle Net, Ubisoft Connect > Windows Store? I'm assuming those will be the ones above it.

I'm not entirely sure how Microsoft views PC platforms. Xbox app is intertwined in Windows Store. Battle Net and Ubisoft Connect are only for that publishers respective games, and not an actual storefront. So maybe Microsoft is including things like Humble Bundle and Green Man Gaming?

I had to post it this way because Idas blue text doesn't come through via copy/paste.

Nintendo isn't really a competitor because they have Wii Fit and they don't have traditional games, they compete with fitness apps and non-gaming apps.

What. The. Fuck. They had to go back to 2008 to make an argument and even then, it would be a nonsense argument.

Omfg, I apologise on behalf of the UK. What the fuck is CMA saying, this is hilarious.

I'm actually a little unsure on if it will pass CMA now, if it doesn't, Microsoft will take them to court, but a lot of these arguments are awful and boil down to "What about poor Sony?!"

There is something really odd about CMA's framing, it's like they got their talking points directly from Sony themselves and have barely bothered to do any research into the market.

Omg, I apologise on behalf of UK. What the fuck is CMA doing, this is hilarious.

I'm actually a little uncertain it will even pass CMA now (Microsoft will take them to court though). A lot of these arguments are terrible and boil down to "What about poor Sony?!" OH MY GOD!!!! sorry, THIS is Dr. Evil levels of stupid right here!!!

Yeah, I'm definitely not going to pay attention to any concerns the CMA has going forward. Not that they were positioning themselves in a fair way anyways!

The CMA says that PlayStation's success is not driven primarily by its technical superiority (as MS suggested). Gaming content is an important driver of demand, and PlayStation's competitive position could be materially harmed if CoD were not available (or not available on equal terms) on its console post-Merger. Whilst MS submitted that PlayStation itself has some exclusive franchises, such as Marvel's Spiderman, the CMA believes that these do not come close to having CoD's level of success.

"PlayStation's competitive position could be materially harmed if CoD were not available (or not available on equal terms)."

"On equal terms" - So, exactly what Sony is doing RIGHT NOW?

Why is CMA giving air to this ridiculous argument that even if CoD stays multiplatform, mean old Microsoft might make exclusive content, which is exactly what Sony does right now

On behalf of the rest of the world.

...to avoid getting banned for inactivity, I may have to resort to comments that are of a lower overall quality and or beneath my moral standards.

I guess the UK regulators are still living in gen 7. Nintendo Switch only sells well because of non-traditional games? Their non-traditional games this gen like those LABO cardboard construction kits and Ring Fit are far from being their top sellers, the top sellers are all traditional games, Super Mario Odyssey, Mario Kart, Zelda BOTW, Pokemon, Animal Crossing, Smash Bros, etc. Ring Fit is their highest selling non-traditional game at #10 and it will soon be bumped out of the top 10 by Pokemon Legends Arceus (Nintendo hasn't released a sales update for Legends Arceus since 2 months after it released, it likely already passed Ring Fit).

- MS/ABK would include some of the biggest and highest selling franchises across various genres, such as shooters (eg CoD, Halo, Gears of War, Doom, Overwatch), role playing games (eg World of Warcraft, Elder Scrolls, Fallout, Diablo), racing and flying games (eg Forza), action and adventure games (egMinecraft), and others. According to one of the Parties' competitors, the only category where Microsoft would not have a leading position post transaction would be in sports games, where Electronic Arts has the strongest position.

Genre Monopoly is a thing now ???

Lmfao.

Discounting that genre monopoly is not a thing, and it would be absolutely dumb as shit to argue otherwise, all those games are wildly different from one another, Forza is not a flying game (I think they meant to list Flight Sim), there is a huge difference between RPGs and MMOs. Minecraft is a Sandbox and Mario Kart is the bestselling racing game.

-

The CMA considers that Nintendo competes less closely with Xbox as compared to PlayStation, by virtue of its differentiated content, target audience, and differential technical capabilities. This theory of harm therefore focuses on Sony. The CMA has considered (i) the ability of MS/ABK to harm Sony through total or partial foreclosure of ABK games, (ii) its incentive to do so, and (iii) the effect of such strategies on competition.

CMA is entirely focusing on what harm it could do to Sony and ignoring that Nintendo does just fine without CoD because Nintendo isn't a true competitor thanks to Wii Fit ?

Discounting Nintendo entirely is absolutely ridiculous, they are a major player in the market who survives without CoD, how the heck can you just ignore that.

They really haven't done any research into the market and are just listening to what Sony tells them, I wish we could skip to court already because it feels like where this is heading.

Sorry, I know I commented on this already, but I have to add more, who was the dumb "competitor" who claimed this ridiculous statement?

"The only category where Microsoft would not have a leading position post transaction would be in sports games."

I'm sorry, the only category? So, you're telling me that Microsoft will have a leading position in the following.

  • JRPGs?
  • Platformers?
  • Fighters?
  • Horror?
  • Survival?
  • Action-Adventure?

This is absolute nonsense, Lol. ABK doesn't even add any JRPGs, they add Crash to Platformers, but Nintendo is the king of Platformers, and we don't even know if another mainline Crash is coming. Microsoft has next to nothing in the way of Fighters aside from the dead Killer Instinct which doesn't come close to Mortal Kombat or Street Fighter.

They have barely anything in Horrors. They do have popular Survival titles but again there are Survival titles far more popular than what Xbox offers. Minecraft is not an Action-Adventure, it's a Sandbox, Action-Adventure is if anything a lot stronger for Sony than Xbox even with Activision-Blizzard. They don't have a leading position in Racers due to Mario Kart, but CMA is ignoring Nintendo for some insane reason.

Do they have a leading position in MMOs thanks to World of Warcraft or has XIV taken it over? Uncertain.

They're really playing fast and loose with the definition of "leading position" All ABK adds in the short term is Shooters, RPGs and MMOs, Microsoft is still weak or doesn't have the most popular IP in several genres and since ABK is only adding Shooters/RPGs/MMOs, it would suggest that CMA already believe Microsoft leads in all those other areas aside from Sports, that is ridiculous.
