I belive the constitution is law as well, no?

Yes, the difference is being able to understand which situations fall under which laws.

And isn't it true that there is no situation inside the USA that shouldn't fall under the constitution?

The analogy you are making is flawed at best. Diplomatic immunity is not a human or constitutional right...it is given to foreign (people not governed by our constitution) diplomats. Yes, people can get away with all types of crimes (sometimes murder), but the country allows this (privilege as it's not given all willy nilly to any foreign joe) in order to gain the same privileges; our diplomats have the same immunities in other countries. In some cases, that privilege can be revoked. We've tried diplomats for murder in this country. But it's true that some have abused the legal system, because they've had diplomatic immunity.

The constitution, on the other hand, is the top law of the land for our citizens, and the particular subject we're debating, The Flag Protection Act 0f 1989, has been struck down by the Supreme Court in lieu of it contradicting the constitution. In this case, the chick isn't abusing the legal system like a diplomat might if he committed a crime while protected by diplomatic immunity. The constitution isn't some shield from the legal system. It is the basis for our legal system, so if a law is struck down by it, it's no longer enforceable. That is the key difference.

Apples to oranges.

It's an example of the abuse of laws that are meant to protect instead of allowing anyone to do whatever they want.

Are you actually comparing full-on murder to pissing on a flag?

I would not think people being pissed about this would be a liberal/conservative thing ... are you saying liberals aren't nationalistic?

I typically see conservatives being the mote nationalistic type.

My bad I should have used the word patriotic, nationalistic has a bad connotation.

It kind of makes me sad since it is a powerful symbol for many of our military.  My Grandfather lied about his age (16) to fight in the second world war. He then went on to fight in two more wars for his country. He saw many people give their lives and to many of them the flag ("for which it stands") is more than just a piece of cloth.

Why chose a flag if you just wanted to express yourself by pissing on a piece of cloth? I would think some would see it as an ironic way to piss on their sacrifices (limbs, liberties or lives).  I'm also guessing few here have every sacrificed as much for other people's freedom.

I think most soldiers are more concerned about the actual people than the flag. If the flag magically disappeared, I'll guarantee you people like your grandfather would still risk their lives if it means they help others

The irony in here. She's expressing herself which is a core tenet of this nation. Those of you wanting her killed, deported, fined, humiliated, etc....are thereby advocating for the removal of that freedom of expression. Meaning you want America to become something it is not....just as she does.

Thats not true its exactly what America is, most other countries didnt have a second class slave soceity or concetration camps for native people, and then there was the mccarthy era which was not too long ago.

I don't disagree with that, that does not make the flag any less a symbol that was in fact there while he and others were risking thier lives. She has every right to do what she did it just shows an utter lack of respect for those that bled and died for her right to express herself.

Won't lie. It is disrespectful, but threatening to kill her is too far.

agreed - call her a stupid twat if you must and move on, again she is seeking attention so the best move in my book would be to ignore her ass

I think we should ignore her—but not ignore the people calling for her death.  The way I see it (disclaimer:  I know only what I have gleaned from this thread), she likely did what she did to protest exactly the sort of ultranationalist flag-fetishizing that produces the extreme reactions that she got.  Ideally, everyone would simply turn away in disgust and nothing more.  People like your grandfather are unfortunate collateral damage; her true target was the people that have now threatened her life.

I hope she's not going to whine about getting the reaction she was aiming for.  (Denunciation=/=whining)
