What no way in hell! Nintendo is doing their best to bring back as many of their older IP's as possible and to create new IP's! Nintendo has a history of outsourcing its old IP's and unsupported IP's games like StarFox, MetroidPrime, Donkey Kong.
But they do not just give a liscense out and then let the developer do as they please. I mean yes Nintendo is known for giving the developers alot of creative freedomes they are not really known for giving them a free slate. Both Metroid Prime and StarFox were pushed out ahead of the expected time (Developers had to meet dates). Now of course with StarFox Nintendo gave Namco some breathing room but it was eventually announced that the game would be launched ready or not on a specific date. I remember all the talk that Namco hadn't been able to perfect the game before it was released!
Factor5 is well known for using existing IP's (StarWars/PilotWings) even though PilotWings never saw release it was widely known that Factor5 had been developing one. So thats another very real idea , Factor5 could have easily gone back and salvaged the old GameCube game they were developing and picked up where they left off!
As for Lair destroying Factor5's credibility the game wasn't that good apparently (never played myself) but it was visually impressive and the game also supported the PS3 Axis controller and that shows Factor5's ability to adapt and create new control concepts to make use of the Wiimote!
