I disagree.
First party:
Developer and publisher belong to (or are) the console manufacturer. (For example Turn10 makes Forza for Xbox, MS is the publisher)
second party:
The publisher belongs to (or is) the console manufacturer, but the developer does not. (For example Epic makes Gears of War for Xbox, MS is the publisher)
third party:
Neither the publisher nor the developer belong to the console manufacturer. (For example Infinity Ward makes CoD for Xbox, Activision is the publisher)
If we follow your logic, a former Sony first party developer became a Microsoft first party developer and MS did not even pay a cent for it. (Insomniac)

After the release of The Last Story in 2011 and the mobile titled Party Wave and Blade Guardian in 2012 Hironobu Sakaguchi’s Mistwalker has been quite silent. No official announcements of new titles have been made and the Twitter account hasn’t tweeted anything since March of 2013.
Only the Facebook account has shown relatively recent signs of activity, mostly showcasing events that involved Sakaguchi himself, and a new cover photo in September (you can see it at the bottom of the post) that some took as a hint of an incoming game announcement. The last post is dated December 17th.
Recently something new happened, and unfortunately it isn’t positive: the studio’s homepage domain expired on March 18, and is now pending renewal or deletion. The site itself has been taken down and is currently unavailable.
It’s definitely early to theorize doom and gloom scenarios, and the domain may simply have expired because of an oversight (it happens even to the best, and especially to Sega), but combined with the extended silence it leaves us wondering about what Mistwalker and Sakaguchi-san may be up to.
We have reached out to Mistwalker asking for a clarification on the issue (with the additional hurdle that most of their usual mail accounts seem to be down as well), and we’ll keep you updated if we’ll receive any relevant information.

This would make sense I guess seeing as that game is doomed. Although I believe I read something about it being on 360 and PS3 and no thoughts of next gen spoken recently by him, maybe im wrong

I don’t think there dead yet besides one of the websites still works http://www.mistwalkercorp.com/.I think there either working on a excusive game with Nintendo or Microsoft and are probably waiting for a high profile( e3,tgs) event to announce it.
I'm surprised Microsoft didn’t make a move on Itagaki when he left Team Ninja since he was such a Xbox fan and make Valhalla Game Studios a first party studio.

You just are consunsing Studio and IP/Game... there is no IP/Game second-party... there is Studio second-party.
Insomniac was a second-party developer (exclusive to Sony) working in a first-party game (Sony own the IP)... now Insomniac is a third-patry developer working in a first-party or third-party IPs.
It is easy the terms.
Turn 10 = Fist-party studio becasue MS own them
Forza = First-party IP because MS own it
Epic = Third-party studio because they work with who they want
Gears = Third-party IP because Epic own it (before) / First-party IP because MS own it (after)
Capcom = Third-party studio because they work with who they want
Dead Rising 3 = Third-party IP
Insomniac = Second-party studio because can work only with Sony (before) / Third-party studio because they work with who they want (after)
D4: Third-party (if Insomniac own the IP) / First-party (if MS own the IP)
Racket & Clank: First-party IP becasue Sony own the IP
You can disagree but that's the definition... publisher didn't change that for example Demon's Souls.

Publisher = A company that I didn't remember the name... Atlus?
Ghostbusters is published by Sony and it is third-party IP by a third-party developer.
You description didn't fit the industry.
Again the categorization is...
Studio: First/Second/Third
IP/Game: First or Third
There is no other option... the game be exclusive or not is another subject... if for example Sony wants a day to put Gran Turismo on Xbox they can... what make it exclusive is the fact Sony just release it on PlayStation.
