This is the issue is it not? Legality aside, surely it's the opinion of youtubers that is in question.
@Damagon - your use of previous campaigns don't help the argument against it as it's a standard agreement, but in most cases Machinima just mean mention E3, mention Pax, they don't mind surely if you insult it as long as you mention it. (unless in their terms is the same sentence above...)
@selnor1983 - MS advertising scheme aside, would you trust youtubers opinion if they can be swayed by an extra $3?
@ioi - I don't think this is the same as what you think. Yes, a lot of advertising is just giving a media outlet money or a free copy of the product to review but that money/product doesn't usually come with the incentive to give it praise when maybe none is deserved. Top Gear have reviewed many cars over the years, but many times they compare the cars to other competitors cars and choose that over the car they are reviewing even if they say it's a good car. They mention good and bad points in their flashy TV review. Omitting the 'bad points' for the money is the part surely in question.
Overall, I'd think that the morality and trustworthiness of youtubers is the real concern as they are the ones receiving money for being deceptive.
