They'd probably be reviewing the next gen games on test kits, not retail units. That would allow them much more control and flexibility since they run different firmware than consumer versions and wouldn't have to worry about the day one patch.

Looks like both consoles require a day one patch. I would bet one of these is the "stupid" reasoning mentioned.
