I imagine it would expect the ruling to go something like this. "You have the right to sell steam copies, however valve isn't required to give you the method to sell it."
I kinda feel like Valve would welcome "losing" this case though. Then they can make games transferable via steam market and colect themselves a percentage of the sale.
All while not having to negotiate with game developers. Which is what they would have to do now if they wanted to sell used games.
