If it's true that they never charged your card, then game over. 
On the other hand, if your next card statement shows a charge, then credit, they have to honor the order. Dell lost just such a suit in Federal court a couple of years ago... laptops for $100 bucks or so. Ouch!
Once "money" changes hands, it's a done deal from a legal perspective.
