So true, he hacked his own product and didn't use it to steal software and such. But his hacking lead to people finding ways to use their PS3 for crime. So his hacking did end up helping criminals its just he himself wasn't a criminal.

Everything can be used in illegal ways. I can clobber you with a book, do I blame the publishers?

Depends. No one would use a perfectly interesting book to smack anyone. However, one would not hesitate if the book was boring. So, if the publisher went ahead and published a turd, it's totally their fault. If they made a good book, and someone still used it as a weapon, then we've got to delve further into the matter...who made the paper that the book used? Was it good quality paper or poor? Still can't solve the question as to who to blame? Who grew the tree that provided the paper? Was it a person, or did it happen naturally? And this is where you can assign blame (if the earlier steps failed to assign blame to the proper parties involved).
To sum up: blame everything/everyone else except for the one actually at fault...ie. the book clobberer.
