It doesn't deserve it. Having beaten the game, it is far from the best, but it isn't that bad either... not by a long shot. Ironically, the parts I hated the most were the Half-life wanna-be modern, thinking-person's FPS, crappy parts. You don't buy a Duke game for its brain teasers, and you know it's bad when the game itself suggests that you cheat by reading internet walkthroughs.
To its credit... when the game lets you fight like Duke was meant to fight it was fun - a true guilty pleasure. Remember that, Gearbox, for the next one... and PLEASE do try again.
I also think that people expected way too much from the game. Hell, it went through 4 dev teams and 5 engines. 15 years was NOT enough time for that. And, YES, it was Broussard's fault for being a perfectionist. They should have released DNF in 2003 and then its SEQUEL now.
As for the prudes who voted down the game due to its content... I have nothing polite to say to you.
Also, I say the king will rise again... and in less than 15 years no less!
