Forums - Sony - Sony and Geohot reach a settlement

dsister said:

1. Geohot walked away without any problems m

2. Sony spent over a million dollars trying to prosecute him

3. Sony lost a customer(who bought quite a few PS3s)

yes, Sony definitely won

According to the injunction, the injunction itself applies to every hacker that Geohotz has contact with.

I'm guessing that the subpeona for all those IPs, personal information, etc etc has something to do with the scope of that victory.

A private settlement can't make a ruling for anyone but the parties involved. Nor can they used any of collected data beyond the scope of what the courts allowed, which was only to establish location of alleged activity.

Anyone can guess. It takes no effort to throw out lots of predictions and have some of them be correct. You are not and wiser or better for having your guesses be right. Even a blind man can hit the bullseye.

Isn't this a win for other PS3 hackers? Geohot may not be allowed to continue his work but this settlement won't affect any others, which it would had Sony won.

When the next guy steps up and releases some PS3 hacking tools and Sony sues him/her they will have to start from scratch again...

Unless Sony felt they were going to lose the case, reaching a settlement doesn't make any sense. They could have gained some serious ground in the PS3 hacking war had they won the case. The hacking of PS3's would probably been made illegal and the whole PS3 hacking scene would had taken a serious hit. Now none of that happened.

Actually, it will effect others.  Geohot legally agreed to Sony terms.  Therefore anyone else who does the same that Geohot was taken to court for could also be subjected to the same penalties set forth when caught and tried.  It's not so much about Geohot, but moreso that his actions were agreed to be illegal.  All the lawyers have to do is pull this case out as proof.  Geohot sold himself out.

Its not that simple. Its fairly obvious that given how vocal Hotz and those in his corner have been, i mean the kid made a rap video and posted it on the internet, blogged about it had Anonymous making attmpts to hack and destroy all things Sony, that the "hacker community" was outraged, ready to fight, this was a violation of rights etc. on and on.....yet when push came to shove, when little George was facing the music he caved. End of story.

Youre talking about a huge multinational corperation that set out to show this hacking will not go unnoticed, they didnt set out to ruin this kids life or destroy him like you are leading on.

It seems  alot of people here get lost in the epeen pissing match of all or none from these forums. Like MUGEN ( I think) said they never intended to bury this kid, settling out of court is a "win" for Sony because it shows how quickly the vocal hacking community will crumble when push comes to shove, when they cant hide behind their forums and youtube videos, when they have to face grown ups in court, the legal system and be held accountable for their actions.

Its a "win" for Sony because now we have public record of a hacker who "did no wrong" in a lot of peoples eyes settling out of court because he knows damn well he did wrong, Sony wins because the point was made regardless of litigation precedent, now they dont come off as a huge corperation ruining a kids life over a matter which could be portrayed as "the man" hustling a kid. They got what they wanted, sans bad publicity, Hotz settling is admitted guilt in the court of public opinion......

Just like those aqful lawsuits of record companies sueing people who illegally download music for obscene amounts of money to "make a point" like you want....its not smart, it rubs people the wrong way and Sony gt what they wanted, they wanted him to back off, send a message they are paying attention and they were very succesful without looking like a trolling huge corperation coming down on some punk.

Its fairly obvious why this is a one sided settlement actually the more i type about it, some people just will not admit it because of the parties involved though, sadly.

Epic post is epic... for me that was the thread end .

its a win for all the artists, developers, techicians, and most importanty legit gamers.

i cant believe some people are shocked by a hacker's lack of principles who had his legal fees paid for. lol

And that's exactly what Geohot is o.o

But be honest here. How would 'legit' gamers be affected either way??

hahahahahahaha
really?

yes really, thats entirely what he was.

I guess our definition of "legit gamer" differ in the sense that I see a L.G as a person who buys a console, gets the game, plays it and that's the end of that. Didn't realise you had to hack your system to be considered "legit" I guess I've been doing it wrong all these years :(

I wish this had been tested in court. It would have been groundbreaking to have a ruling that Sony has no power over the machine's software after they sell it (which is the only result that wouldn't produce chaos).

Same. Now we're gonna see some other fucked up company trying to act like what I bought is their property.

If you remember, APple tried to push off jailbreaking as illegal and they got screwed by that, so the sooner another retard company comes along and gets slammed by the courts for their shit business practices, the better.

Though, this action has never been about removing the right of people to modify what they own.

i texted a friend of mine who is a lawyer and he said that while it is "not likely" that this settlement can have a "precedential value" there are "exceptions".    Then he told me to research "judicata", "collateral estappel" and "judicial estoppel".

I have no clue what that means but i'm going to look into it a bit.

also, this thread is epic fun. xD

ugh again did you miss him saying he was fighting for our rights bla bla bla in the media (even in the rap video lol),,about how he was saying he will surely win, how sony has no case against him etc etc.? and not to mention this is the guy who were taking pics with philips T's on LOL and actually made the most lame ass song (if you can call it that) next to Blacks' Friday! Sony got exactly what they wanted :)

he came off looking like a real idiot to me :) I can understand why some might NOT want to see it that way even if it's the case

And from what I see we are still allowed to do whatever we want to our PS3s. Geo wasn't sued into oblivion as most of you guys were hoping for. Sony looks like it bowed to the pressures of Anon, as well as losing one of the better PS3 fans(he owned what, like 6 PS3s?) around.

Well, you aren't exactly non-biased...

How exactly did Sony bow to Anon?  According to the article, the agreement was reached on March 31, 2011.  Anon successfully attacked Sony's sites and posted the Youtube video on April 4, 2011.  This agreement was already reached before Anon attacked.  If anything, Anon bailed out because of the massive backlash they received from PS3 gamers.

What do you think it will mean on the long run?

WOW! Didn't see it coming, I expected more a Sony-LG settlement. Anyhow the article doesn't give any detail about the settlement. If it's covered by a NDA, should we think Sony paid him to hack 3DS instead of PS3 from now on?
