THis DOES however send out a message, hotz who was so determined, had financial backing of 'fans', who had media coverage, who had a promising career in rap, settled only because he knew he can't win! You honestly believe if he thought he had a chance to win he wouldn't have gone all the way? SO again it's he who had to go against all he stood by so far, sony is still standing strong with what they stood for.

If their case was watertight there is no way they would have compromised...  why would they?  for what?

you can ask the same Q other wway too..no one put a gun on hotz's head and ask him to settle. Sony wanted him to back off from the begining and that's exactly what they got now. If he messes with anything sony again he will be fined from 10k to 200k or something. Why should sony bother any furthure? The so called freedom fighter now and forever will be ridden of from sony products, sending him to jail could have lead to bad publicity. The message from this outcome is clear, hotz backed down ONLY cuz he knew he can't win this one, if you think otherwise you're being silly, hotz would have not stopped till the court ruled against sony. not like he wouldn't have money since people seem to be willing to pay for the court (and who knows maybe even his vacation :) I don't trust his word)

Why did Sony ALLOW Hotz to back down.. why didnt they say fuck you - see you in court.  Get a nice precendent for future issues and have done with it?

So are you saying that you cannot fight back to prove your innocence when being sued?  And can you not counter sue when found innocent?  So why couldn't Geohot do so?

what I asked was..

Why did Sony allow him to settle out of court with some half arsed injunction?  How does this help them in the future if someone else has a go?  They should have had their day in court and got a precednet.

Like Kowenicki said if it was so clear cut why didn't Sony just bury him. Sony was still putting their case together... The only thing that would of happened if they continued would be that Geo would of drowned in debt. I guess that's one form of winning... one where justice is kind of trampled, but whatever. 

And yes, with the less effort. Wow, he made a blog post for donations, and posted alink to his paypal...

Oh I'll start with the bold part then, for sure :) I always thought of him as a real moron and wanted him to back the *%&^ off from PS brand altogether. I don't want my experience ruined cuz of some dumb kid (wait how old is he? :S kid by actions imo, not by looks I guess) My stand point on the matter has been clear from the begining.

I explained it to kowen, suggest you read that one, don't wanna type all that again. Sony did what's smart, fold while you're ahead and get what you wanted.

and again, he did all he could to gain attention being the attention whore he is and asked for donation (which he got plenty)  went on other media to talk smack about how he will win in the end...he did put a lot of effort. sony didn't scream or shout, go to tv and talk about, they played it professionally and got what they wanted in the end. Hotz has to do exactly what he didn't wanna do in the first place

He won not being sued for something that Sony maintain was illegal.

Sony won an injunction against one guy after spending millions gathering evidence in a rather aggresive way that has Anon all over their arses.

so what is sony MADE the ps3.  Was geohotz RENTING it?  pretty sure he bought the ps3.  If he wants to buy it take it out the store and smash it he can.  If he wants to take it apart and build a robot dog with the parts, he can.  If he wants to install windows 98 on it, he can.  If he wants to turn it into a bomb he can.  now the gov't might not like him making a bomb, but the ps3 and sony have nothing to do with that.

so until you show me geohotz doing something Illegal, like breaking into psn or anything that is messing with something of SONY'S, i have no angst against geohotz.  he can't be held liable for pirates taking advantage of something he did with no intention of piracy. 

should a boat maker be held responsible for a group of people that use it for piracy?
