this isn't even a question anymore, Mark came out and directly answered this question -- MS doesn't have any right to gears of war.

Some interesting news to bring you involving the future of the Gears of War franchise now, as Epic’s Mark Rein has stated that they, not Microsoft, own the rights to the GoW IP – adding that they are free to ‘do what they want with it’


If that was the case, then why hasn't Gears 2 come out on PC? Answer: MS controls where Gears can and cannot go. And a written copyright statement from the xbox website > Mark Rein's word.

The official website as hosted by the publisher?  Or did you expect the official page for a game published by Microsoft to go somewhere else?

And do you not know the difference between a copyright and a trademark?  Referring to Wikipedia, as they can summarize this far more succinctly than I can, a copyright is "a set of exclusive rights granted by the law of a jurisdiction to the author or creator of an original work, including the right to copy, distribute and adapt the work." 

This refers specifically to who has the right to distribute the first Gears of War as it exists on 360.  And if you notice, Microsoft only holds this right for the game's underlying technology, while Epic owns the rights to everything else.  Microsoft's copyright has no bearing on sequels or spin-offs or anything other than the underlying technology of the game as it exists on 360 and PC.

A trademark, on the other hand, is "a distinctive sign or indicator used by an individual, business organization, or other legal entity to identify that the products or services to consumers with which the trademark appears originate from a unique source, and to distinguish its products or services from those of other entities."

In other words, Epic owns the Gears of War IP, and as such they can do whatever they want with it.

I never claimed Epic didn't own parts of the IP, I just claimed that MS did, and as such, they can control where the franchise can and cannot go. I believe I have proved my point.

They don't own it, they own parts of it, so they can stop Epic from porting the game to a competitor's console.

I don't want Sony out of the handheld market, but unfortunately the 3DS and Iphone will make sure it'll happen.

All Rein said was that a Gears of War Style game would be fitting to see on the NGP and it obviously doesnt fuckin mean that Epic games are making Gears of War for NGP. It means they're probably developing a great Third Person Shooter for the NGP.

Epic’s Mark Rein has said that the developer owns the Gears of War IP, and can do with it what it pleases.

 

Speaking with VG247 at GDC last week, we asked Rein to clarify for some of the more paranoid out there, whether or not Microsoft had some nefarious hand in the developer’s cookie jar.

Turns out, that’s not the case as some mistakenly believe. Epic can, and do choose whatever publisher it wishes for the games it creates.

“We own Gears of War. We can do what we want with it,” Rein told us. “We have a great relationship with Microsoft, and they helped turn the game into a huge success for us, and we are pretty happy with the way things are going”.

If Epic really owned Gears, we would've seen Gears 2 on PC right now and Gears on Mac. At the very least we would've seen a Gears spin off on PS3, PSP, Wii, iphone, DS or whatever. ME came out on iphone before it was announced for PS3 so everyone knew it was possible for it to go multiplat.
