Forums - Microsoft Discussion - Kinect IS Spying on You (wow)

You cannot  enter into a contract that involves either party to that contract breaking the law.  The contract would be void and if what MS is doing is illegal they would be in trouble.

So... If there is any aspect of this is illegal or against any rights then it would not be there or will soon be removed and MS will be heavily fined  I doubt the lawyers of such a biog organisation are so stupid...

Then again...

http://news.cnet.com/8301-1023_3-10122375-93.html  Sony stealing data on children

http://news.cnet.com/Sony-recalls-risky-rootkit-CDs/2100-7349_3-5954154.html?tag=txt  Sony and the rootkit fiasco.. thye could have hacked your PC and watched everything you did if they had wanted to.

and possibly the worst from those cuddly-friendly-weirdy-beardies at Google.. (god knows how they escaped a very heavy fine for this)

weren't there major boycotts against sony for that though?

Note what I said in a previous post - I don't think MS will misuse the Kinect. But one or more corrupt(ed) MS employees might for the right amount of money?

or any bank official, or any post man, or any mobile phone network worker, or any pc technician etc etc etc etc etc etc etc etc etc etc etc.

Actually true, and more than a few times you hear of one of those being caught (and i am sure there are a lot of cases of people not being caught). There's a difference though (in my eyes) between a service I have no choice but use (and some of those have actual protections if they are misused) and one where I have a choice whether to put in my house or not.

So you dont have a bank account, mobile phone or post delivered then?

You are trying to spin this as something extraordinary... it really isnt.  We run this risk every minute of the day from all kinds of service and product providers.

While you are sat in your home, the bank teller at your bank could be happily selling your bank details to his mate for $10.  The postman could be stealing your identity and the techinician at the mobile phone company could be getting ready to blackmail you over those dodgy texts you sent to sexy Susan in the office...

If you read what I wrote, you should have noticed I wrote "there's a difference though (in my eyes) between a service I have no choice but use (and some of those have actual protections if they are misused) and one where I have a choice whether to put in my house or not."

But the real question is... How the hell did you find out about my texts to sexy Susan????

This is to help law enforcement in catching pedophiles, retrieving stolen consoles, retrieving communications for missing people, etc.  I support it since it means protecting people and possibly even saving lives.

Yes, I have absolutely no problem with M$ being able to do this, they almost certainly already can with voice chat and messages and I am sure Apple have the same agreement with Facetime

ummm...i dont see the issue.  this is the same for video and voice stuff now.  if someone reports you then they can check this stuff out.

Just to be curious what video and voice stuff?  Until I got an Eyetoy (and if I get Kinect) I've never had anything in my house that can record/hear me.  Do you mean CCTV?  Or when people drop of their PC to get fixed forgetting they left a video of them robbing a bank - not to forget the Gary Glitter incident with the child porn.

This is different case to either of those scenarios I'd say.  Not that I think it's an actual issue myself, although I can see it drawing some unwanted attention.

Try to be reasonable... its easier than you think...

A majority of software you use in communications is allowed to be disclosed to authorities. Facebook, WoW.... so on etc. That's nothing new. It also has nothing to do with Kinect. The definition clearly states communications in regards to other people over the internet. This really is nothing. It's not like anyone had any privacy anyway. If you use the internet you already forfeited it. If you really want privacy in gaming. Don't get one that connects online. If you want privacy period. Become a hermit.

Squilliam: On Vgcharts its a commonly accepted practice to twist the bounds of plausibility in order to support your argument or agenda so I think its pretty cool that this gives me the precedent to say whatever I damn well please.

Facebook can't upload to its servers your pictures and videos unless you do it. So the issue is to know whether Kinect gets your videos when you are playing online multiplayer, and this would be normal (but there should be the option to not transmit your images, but just your moves in the games, if you so want, for example you could be a nudist gamer and wishing to be seen only by people considering it acceptable), or if it does it by default even if you aren't playing online and if you didn't authorize it, this shouldn't be allowed, it's against any privacy law of any civilized country.
