Sure that's probably a decent bet, but making patenting a game that's just a slight alteration from one that already has been announced doens't really show how innovative and outside of the box they are.

Well, I'd say the way the VS apparently works and how it's used to measure the things explained in the OP, and make them into aspects of game-control is extremely innovative to no end, really.
Of course the simple game concept mentioned in the patent isn't at all representative of any game that might come out for the VS, it's simply meant to convey how the device will work, and give a brief explanation of what could be a possible option for a game.
Just take a look at something like the Balance Board, and the crazy amount of things Nintendo's come up with in WiiFit/-Plus that make use of it. That's what I mean when I talk about Nintendo's innovation. I'm very sure they'll come up with tons of fun, crazy, deep and intelligent ways to use the VS in games, too.
That Ubisoft game on the other hand, is apparently a full game based around this one thing... and it didn't look very fun to me, did it to you? That's what Nintendo's good at, and why games like Brain Training and Wii Fit have become so popular: they make mundane things fun. That's also why I'm convinced the VS will be successful, when it releases, 'cos Nintendo will make sure it'll be fun to use it.
