Not really. It is hard to prove that someone was raped, rather than it being easy to disprove it. The first thing many women (or men) do after being raped is have a thorough wash, removing the evidence. totally understandable too i would think.

And where there is evidence, it's hard to ascertain whether it was consentual sex or not.

Unfortunately, if you are a man and you are accused of rape, even if there is no evidence, and no case, you'll have to live with the stigma of the accusation for a very long time. There will always be question marks over your head about whether you had or not.

The parents and the child (they knew damn well they shouldn't bully) are to blame.

Although a wide range of actions qualify as "rape". Maybe he just stuck his tongue in her ear or something? I saw a news report on yahoo about an 11 year old girl and her mother suing some boys in court because they kissed her. It was bad, certainly perverse bullying, but it was qualified as rape. I don't think of a kiss as rape, i'm sorry :-/ Sure, they should still get the full penalty for being asses, but that word is extreme.

I thought it was a little fishy also.
